Former CJI's brother resigns as special govt pleader

Kochi: Amid charges of amassing wealth disproportionate to known sources of income against former CJI Justice KG Balakrishnan's family, his brother KG Bhaskaran on Friday resigned as Special Government Pleader in High Court becoming second family member to quit a post under a cloud.

Bhaskaran resigned citing health problems amid allegations of amassing wealth disproportionate to his known sources of income with his exit coming two days after Balakrishnan's son-in-law PV Sreenijan quit Youth Congress on similar charges.
Court sources said Bhaskaran, who was looking after various cases of Scheduled Castes and Scheduled Tribes, sent in his resignation to Advocate General CP Sudhakara Prasad.

Bhaskaran told a news agency he was being treated by doctors of the All India Institute of Medical Sciences for respiratory problems and would be leaving for Delhi for further treatment.

"I was finding it difficult to go to court, though I was attending office," he said.

Asked if he had consulted Justice Balakrishnan before putting in his papers, Bhaskaran replied in the negative.

However, he said Justice Balakrishnan had two months ago advised him to resign as he was not keeping good health.

Bhaskaran had gone on medical leave after the Advocate General asked him to either quit as special government pleader or go on leave.

Adding to the woes of Balakrishnan, a complaint has also been filed in a vigilance court seeking a probe into charges of amassing wealth disproportionate to known sources of income against his family members.

A vigilance probe is on against Sreenijan, who unsuccessfully contested the last Assembly polls on a Congress ticket.

Chief Minister VS Achuthanandan had said this week that his government would take action against Bhaskaran if any complaint was received against him.

Former Supreme Court judge Justice VR Krishna Iyer has demanded a judicial probe into allegations against Justice Balakrishnan's family members.

Swamy's complaint against Raja maintainable’

New Delhi: A Delhi court on Friday held as "maintainable" a private complaint filed by Janata Party chief Subramanian Swamy seeking prosecution of former union telecom minister A Raja in the 2G spectrum case.

"I am of the opinion that complaint as such is maintainable," Special CBI Judge Pradeep Chaddah said.
The court said that first of all Swamy will have to depose as a complainant in the case and then only his plea, seeking appointment as a deemed public prosecutor, could be decided.

"You cannot assume the roles of a complainant and a public prosecutor simultaneously," the judge said.

"I am not seeking the dual role," Swamy replied and added, "I will first testify as a complainant and then would like to assist this court in prosecuting the accused in the massive scam."

The judge said, "I have also gone through the complaint and the bunch of annexures and supporting documents and I am of the view that this complaint is maintainable and the proceeding will continue."

So far as the summoning of the accused and other witnesses are concerned, for that, applications could be filed at the later stage, the judge said.

The court asked Swamy to record his statement during the day.

Swamy had filed a private complaint before the designated CBI court on December 15 last year seeking prosecution of Raja in the 2G spectrum allocation scam.

He had made a three-fold prayer which included that his complaint be taken cognisance of and Raja be summoned to take the case involving a fraud of Rs 1.76 lakh crore to its logical conclusion.

As per the second prayer, Swamy wanted the court to appoint him "as a deemed public prosecutor under the provisions of the Prevention of Corruption Act."

As per his third prayer, Swamy wanted the court's directions to investigating agencies like Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) to assist him in conducting prosecution and in the further investigation into the scam.

Explaining his rational to the court for filing his private complaint before it, Swamy had said that though the CBI has registered an FIR in the matter, it has named no body as an accused.

Quoting from the CAG report, he had alleged that Raja committed fraud by adopting the first-come-first-served basis in allocating the spectrum to ineligible companies.

85 out of 122 licenses which were awarded to various companies were illegal, Swamy had said, adding that the figure of Rs 1.76 lakh crore has been arrived at by the CAG after computing the losses in allocation of the spectrum.

In his complaint for prosecution of Raja filed under section 190 of the Criminal Procedure Code (CrPC), Swamy also sought directions to the investigative agencies to find out the co-conspirators and other accused in the scam.

Aarushi's parents to get CBI closure report

Ghaziabad: A special CBI court here on Friday directed the investigating agency to give a copy of the closure report in the Aarushi-Hemraj double murder case to the parents of the murdered teenager and posted for January 21 its decision on the issue of closing the probe.

While hearing the case, the CBI opposed the appeal by Aarushi's father Rajesh Talwar to get a copy of the report, saying that he was arrested as an accused in the case.

As the hearing began at about 10.40 am, Talwar's counsel Satish Tamta asked the judge to provide him with a copy of the closure report so that he could tell the court about his views.

CBI counsel RK Saini objected to it, saying that Rajesh was arrested by the police as an accused and, therefore, cannot be treated as a first informant.
Special CBI Judge Preeti Singh then asked the CBI counsel whether the agency has filed a chargesheet in the case.

Saini said that it is "upto the court. The court can reject the closure report and can take cognisance or it can direct to conduct further investigation. If the court feels that the case can be closed, then the court can issue notice to the informants."

The Special Judge, while hearing the CBI plea in the over two-and-a-half year old case, held that copy of the closure report be given to Talwars and posted the matter for January 21.

14-year-old Aarushi and her family's domestic help Hemraj were killed on the night of May 15, 2008 in Noida near here.

The court had on January 3 directed the investigating officer to bring the case diary on the date of shearing for examination.

The judge had also rejected an application filed by Aarushi's dentist parents against closing the case, saying that their plea was not maintainable at this stage and had asked them to appear before the court.

The CBI had on December 29 filed a report to end the probe clearing the names of three servants -- Raj Kumar, Krishna and Vijay Mandal -- in the case.

But the needle of suspicion pointed towards Rajesh whom the agency named as a suspect who could not be chargesheeted because of "insufficient evidence".

Nupur and Rajesh Talwar, who had come to the court at about 10 am, also took on a CBI investigator who was handling the case. In the presence of media, lawyers and police officers in the court, Nupur asked the CBI officer "Why did you do this (submit closure report)? Everyone is answerable to God".

The CBI officer ignored her comments to which Nupur said, "You cannot escape by turning your back towards me".

Saini said the Investigating Officer (IO) had submitted all the case diaries and the court has fixed January 21 as the next date for further consideration of the case.

"My argument was that he (Rajesh) is an accused and not be given a copy. But since the court has ordered that a copy has to be supplied to him we have given him the copy," Saini told reporters here.

When asked whether there was any apprehension on the part of CBI to give him a copy of the closure report, the lawyer said, "There is no apprehension. But an accused will never be satisfied with the closure report."

The victim's mother Nupur said, "According to the CBI closure report, there is no accused as of now. So we may be given a copy of the closure report."

Anushka is refusing to do the lead in a Hindi movie.

While Illeana is happily doing her second lead in her maiden Bollywood film, Anushka is refusing to do the lead in a Hindi movie. Normally, any heroine would die for a lead role in a big Hindi movie.
But Anushka shows no interest. Recently, she was offered the role in a Bollywood flick, remake of the Tamil movie Singam in which she did the lead role. But Anushka didn’t accept it.
Bollywood director Rohith Shetty who is remaking it personally asked her to enter Hindi film industry, yet Anushka declined politely saying she’s "comfortable in South film industry.
"Anushka is the busiest star in Telugu and Tamil and she is in much demand. So she doesn’t want to become another Asin or Trisha who are now back from Bollywood doing South movies.

Although Asin made a grand entry into Bollywood with Ghajini, her subsequent flops made her a no star. Trisha’s first Hindi movie, Khatta Meetha, was a disaster. Seeing their pathetic situation in Bollywood, Anushka wants to continue doing Telugu and Tamil movies.

photoall Madhuri Dixit to play a mother role for Sonam Kapoor

If what we hear is true, Madhuri Dixit may soon playing the role of Sonam Kapoor’s mother in Anil Kapoor’s remake of the Hollywood film, Freaky Friday.
The role was previously offered to Shabhana Azmi, Rekha and Kirron Kher who had to turn it down due to date clashes. Since Anil has said that he would like to work with his former leading lady again, he felt that Madhuri suited the role perfectly. Although she likes the script, we are still waiting for confirmation on her part in the film which revolves around a mother and daughter who magically swap roles for a day.

Could this be Madhuri’s comeback from her previous comeback, Aaja Nachle?
Her secretary and previous manager, Rakesh Nath has said, “She has got four-five very good offers. She will definitely do another film soon, but this time we have to be very careful. I’ve worked with other actresses, but Madhuriji is Madhuriji.” However, we do know she is meeting him since she tweeted, “Meeting with Anil Kapoor today. Lets see what happens….”
When asked about his upcoming venture, Anil said, “It’s too early to comment on any of my new projects, but I would love to work with Madhuri in any capacity at any stage.”

Bhoot And Friends
Director: Kittu Saluja
Cast: Jackie Shroff, Ashwin Mushran and Makran, Ishita, Akash, Tejas
Rating: Two (**)
Advice: A treasure hunt with a ghost, umm…not as exciting as it sounds! A jaded-faded desi version of Indiana Jones.

Ideally, children would the best consumers of fantasies and adventures. But sadly, even today children’s films remain a huge untapped segment in India. Half-hearted attempts such as Bhoot And Friends - only add to the woes of this neglected genre. But then there is always a glimmer of hope and a sense of optimism whenever a children’s film hits the theatres.

The posters of the film held a promise of an adventure and some thrills – what with Jackie Shroff in the garb of a ghost, but the film crushed all those hopes with its slow, imbecile and inane narrative.

Reshma Dev’s story of an 11-year-old and his NRI cousins holidaying in their native village and there running into a ghost, sounds intriguing as a one-line. But as a full-fledged feature film – the story seems stilted and inadequate.

Meet Raghav, a not-so-bright student who accompanies his US returned cousins Ishita and Igloo to his village for the holidays. Don’t ask why his seemingly idle and stay-at-home mom didn’t accompany them! So the kids fly down to the town close to the village and as they travel across the hilly area in a car sent by their granny to pick them up, night falls and they have a brief run into the resident ghost of the jungle.

Even as their granny tries hard to shake off the local rumours about the ghost, the kids find themselves drawn to it all the more. Raghav calls upon his local friend Ali to get a reality check. There he stumbles upon a much bigger and evil plot perpetrated by Gora Saab (Ashwin Mushran), a descendant of a British Colonel who had tried to plunder the local King and make away with the fabled blue diamond or ‘neel mani’. Gora is in search of the lost treasure and the diamond with one of a torn map from his grandfather.

As Gora kidnaps Ali’s father for his property to be dug out in search of the elusive treasure, the four children set out to rescue him. They manage to enter Gora’s den and spirit away the treasure map. But they are caught on their way out and as they run helter-skelter in order to escape Gora’s goons – they end up running into the thick of the forbidden jungle. At dusk, sure enough they are accosted by the legendary ghost (Jackie).

The other missing half of the map is with the ghost. He is the wandering spirit of the army commander of the king who died fighting. He had entrusted his brave commander to restore the treasure to his subjects and given him the map to the treasure. However, half the map was snatched out of his hands by the vicious Colonel and he had died with the other half. Now as luck would have it, both the pieces of the map are in one place and the ghost joins those up and urges the children to find the treasure.

The mazes and tricky paths with fire-spouting gargoyles are definitely reminiscent of Indiana Jones and the treasure hunt. Although not fractionally as slick or as exciting. Hurdles in the form of a blue soapy gurgling water body are just so ridiculous. Even the treasure bearing cave and the guarding spirits are so silly. On the whole, the adventure is insipid and plods miserably.

The climax of the treasure hunt is also so tame and the spooks are so silly that forget about chills – you are so bored that you can’t even laugh at the imbecile proceedings.

Jackie as the ghost is too gentle and friendly, Gora Saab is terribly contrived. The only characters that touch a chord are the four children. Especially polio-afflicted Ali played by young Tejas Rahate is endearing and so is the dimpling, cubby Akash playing Igloo, the fat kid obsessed with his snack bag. Makrand as Raghav and Ishita as Roma are engaging in their own way.

The special effects of the air-borne bag and the invisible punches is far too dated. However the digital intermediate of Jackie on a horse back is impressive. Madhu Kamble’s sets are a tacky reproduction of Indian Jones backdrop, Hanif Shaikh’s action sequences are lackluster.

Alas! Kittu Saluja squanders a golden opportunity of making an engaging children’s film!
